Olivier Dussopt, the Minister of Labor, announced on April 20, 2023, that after six months of negotiation, three agreements had been signed between delivery platforms and representative organizations of independent workers.
A Minimum Wage is Now Set for Bicycle Delivery Riders
In an effort to improve the working conditions of delivery riders, negotiations took place and resulted in three agreements signed by the National Federation of Self-Entrepreneurs and Micro-Entrepreneurs (FNAE), the Union-Indépendants trade union, and the Association of Independent Platforms (API).
These agreements establish a minimum wage for bicycle delivery riders, who were previously paid per delivery and worked in precarious conditions with a high accident rate.
These agreements define a minimum hourly rate to strengthen the protection and rights of bicycle delivery riders.
The minimum hourly wage is set at 11.75 euros per hour of effective work and will be reviewed annually according to the Ministry of Labor.
Delivery platforms will be unable to set a wage below this amount. The president of the FNAE, Grégoire Leclercq, described it as "an immediate gain" for delivery riders.
Other protective measures have been put in place. The law protects workers against abusive termination of commercial relationships, such as disconnections which were previously initiated by the platforms and applied without the delivery rider concerned being informed or able to defend themselves (FNAE press release).
Protection against abusive behavior by customers is also provided, particularly false claims of orders not received.
Among the measures implemented:
✅ The worker must be informed in advance of incidents reported by users and will now have the opportunity to contest them.
✅ The worker must receive an administrative notice before their suspension.
✅ Delivery riders will be able to report incidents or difficulties encountered during a delivery themselves. Platforms will therefore have to set up a communication space that will allow them to do so.
✅ Algorithms will no longer be able to make the decision to terminate a commercial relationship. It must be made by a natural person. The signed agreement indicates "the obligation of human intervention in each suspension procedure."
Future negotiations will take place soon to continue improving the protection of delivery workers, including the right to bonuses and the recognition of the exercise of their activity.
